These Terms & Conditions govern the sale of artwork from this website. By placing an order, you agree to these terms.
1. About this website This website is operated by Stephen Darling, a UK-based independent artist and sole trader. All artwork is sold directly by Stephen Darling.
2. Products All artworks are original, hand-created pieces unless otherwise stated.
Artworks are created using a variety of professional-grade materials, which may include pen and ink, Derwent Inktense, watercolour, and other mixed media. The materials used are specified in each individual product listing. Regardless of medium, only professional-grade materials are used across all work.
Due to the handmade nature of the work, slight variations in texture, colour, and finish may occur. These variations are part of the character of original artwork and are not considered defects.
Images are provided as accurately as possible, but colours may vary slightly depending on screen settings.
3. Prints and reproduction Prints may be produced from original artworks. Purchasing an original piece does not prevent prints or reproductions of that artwork from being made available, unless the listing explicitly states otherwise (for example, where a piece is listed as a Special Edition Original, meaning no prints will be produced from it).
Similarly, the artist reserves the right to create new original artworks inspired by or similar in subject matter to previously sold pieces. Unless a listing explicitly states otherwise, no original artwork is sold as a unique, never-to-be-revisited subject. The artist may revisit locations, subjects, and compositions in future original works.
4. Pricing and payment All prices are listed in GBP (£). Payment is required in full at the time of purchase. Payments are processed securely through third-party payment providers. No payment card details are stored or accessed directly.
5. Order acceptance Once you place an order, you will receive an order confirmation. An order is considered accepted once payment has been successfully processed and confirmed. We reserve the right to refuse or cancel an order in rare circumstances such as pricing or listing errors, suspected fraud, or inability to fulfil the order. If this occurs, you will receive a full refund.
6. Shipping (UK only) At present, shipping is only available within the United Kingdom. Orders are carefully packaged to protect original artwork during transit. Once an order has been dispatched, responsibility for delivery transfers to the courier service.
7. Delivery times Estimated delivery times are provided at checkout or upon dispatch. Delivery times may vary depending on courier services and location within the UK. Delays outside of our control, such as courier delays, are not the responsibility of the artist.
8. Returns and refunds (14-day policy) You have the right to return your artwork within 14 days of receiving it for a full refund. To be eligible for a return, the artwork must be returned in its original condition and securely packaged. The buyer is responsible for return shipping costs. Once the returned item is received and inspected, a refund will be issued to the original payment method.
9. Damaged or lost items If your order arrives damaged, please contact us as soon as possible with photographs of the damage. In the case of loss or confirmed damage during transit, we will work with the courier to resolve the issue.
10. Copyright and intellectual property All artwork, images, and content on this website remain the intellectual property of Stephen Darling. You may not reproduce, distribute, or use any artwork or images without written permission. Purchasing an artwork does not transfer reproduction rights.
11. Care of artwork Customers are responsible for the care of purchased artwork after delivery. It is recommended that artworks are framed behind glass, kept out of direct sunlight, and stored away from high humidity to preserve quality and longevity.
12. Limitation of liability We are not responsible for indirect or consequential loss, damage caused after delivery, or improper handling or storage of artwork by the customer.
13. Changes to these terms These Terms & Conditions may be updated from time to time. Any changes will be posted on this page with a revised date.

11. Licence for personal use
When you purchase an original artwork or print from this website, you are purchasing the physical item only.
All artwork remains the intellectual property of Stephen Darling. The purchase of an artwork does not grant any copyright, reproduction rights, or commercial usage rights.
Artwork purchased from this website is licensed for personal, private, domestic display only.
You may not, without prior written permission:
• Copy, scan, photograph, or reproduce the artwork in any format
• Sell, resell, license, or distribute copies of the artwork
• Use the artwork for business, commercial, promotional, or marketing purposes
• Use the artwork in logos, branding, packaging, merchandise, or advertising
• Modify, adapt, or create derivative works based on the artwork
• Use the artwork in digital media, websites, social media, or printed publications beyond personal sharing of photographs of the physical artwork
Any business, commercial, editorial, branding, or professional use of artwork requires a separate commercial licence agreed to in writing.
Where artwork is created or supplied for business or commercial purposes, separate Business Terms and Licensing Agreements will apply and must be agreed to before use.
Unauthorised use of artwork may result in legal action.
