1. About Stephen Darling Art
These Terms of Service apply to your use of the Stephen Darling Art website and to purchases made through the online store at stephendarlingart.com.

In these Terms, “I”, “me” and “my” refer to Stephen Darling Art, and “you” and “your” refer to the person using the website or purchasing from me.
By using this website or placing an order, you agree to these Terms of Service and the other policies that apply to your purchase, including my Refund Policy, Shipping Policy and Privacy Policy.
If you are a consumer, nothing in these Terms affects any legal rights you have that cannot lawfully be excluded or restricted.
2. My products
I sell original artwork, fine art prints and other products through Stephen Darling Art.
I take reasonable care to ensure that product descriptions, photographs, dimensions, materials, colours and other information provided on the website are accurate.
Colours may appear slightly different depending on your monitor, phone, tablet or other device and its settings.
Original artworks are individually created by hand. Natural variations in paint, paper, texture, line work and other characteristics are part of the nature of handmade artwork and are not defects where they are consistent with the description and photographs of the artwork.
Unless a product description specifically states otherwise, frames and other items shown in photographs for display purposes are not included with the purchase.
I may change product descriptions, specifications or availability from time to time. Such changes will not affect an order that I have already accepted, except where a change is required by law.
3. Product availability
All products are subject to availability.
Original artworks are one-of-a-kind unless otherwise stated. Once an original artwork has been sold, it will no longer be available for purchase.
I may limit the quantity of products that can be purchased where reasonably necessary, for example where stock is limited or where I have reason to suspect fraudulent or abusive purchasing activity.
4. Prices
All prices are displayed in pounds sterling (£) unless otherwise stated.
I am not currently registered for VAT, and no VAT is charged by Stephen Darling Art.
The price payable for a product will be the price displayed at the time you place your order, together with any applicable delivery charges.
If you purchase from outside the United Kingdom, additional customs duties, import taxes, handling charges or other charges may be imposed by the destination country. Where applicable, these are your responsibility and are outside my control.
5. Placing and accepting an order
When you place an order through the website, you are making an offer to purchase the products selected.
After you place an order, you will receive an order confirmation acknowledging that your order has been received. Receipt of an order confirmation does not necessarily mean that your order has been accepted.
I will accept your order when I confirm that the order has been accepted and/or when I dispatch the goods, as applicable.
I may decline or cancel an order where, for example:

a product is no longer available;

there is an obvious error in the product description or price;

payment cannot be authorised;

there is a technical error affecting the order; or
-
I reasonably suspect fraudulent or unlawful activity.
If I cancel an order after payment has been taken, I will refund the amount paid for the cancelled order.
You should check your order carefully before submitting it and contact me as soon as possible if you notice an error.
6. Payment
Payment must be successfully authorised before an order can be processed.
Payment is processed through the payment methods made available at checkout. Your payment information may be processed by the relevant payment provider in accordance with its own terms and privacy policy.
I do not have access to your full payment card details.
7. Delivery
I will provide the available delivery options and applicable delivery charges at checkout.
I aim to dispatch orders within the timeframe stated on the website. Delivery times are estimates and may be affected by circumstances outside my reasonable control, including postal delays, severe weather, strikes, customs processing or other carrier disruption.
Unless otherwise agreed with you, goods will be delivered within 30 days of the contract being entered into, where applicable under UK consumer law.
I remain responsible for the goods until they come into your physical possession, or the possession of a person you have identified to receive them, except where the law provides otherwise.
If your order is delayed, lost or damaged in transit, please contact me as soon as possible so that I can investigate the matter with the delivery provider and take appropriate action.

8. International orders
I may offer delivery to countries outside the United Kingdom.
If you purchase from outside the UK, you are responsible for providing accurate delivery information and, where applicable, paying customs duties, import taxes, local taxes, handling charges and other charges imposed by the destination country.
International delivery times are estimates and may be affected by customs processing or other circumstances outside my reasonable control.
Where the mandatory consumer laws of your country provide rights that cannot lawfully be excluded, those rights continue to apply.
9. Cancellations, returns and refunds
Cancellations, returns and refunds are handled in accordance with my separate Refund Policy, which forms part of these Terms of Service.
Please see the Refund Policy for information about statutory cancellation rights, returns, refunds and any applicable exceptions.
Nothing in the Refund Policy or these Terms limits or excludes any consumer rights that cannot lawfully be limited or excluded.
10. Faulty, damaged or incorrectly supplied goods
If an item arrives damaged, is faulty, is not as described, or you receive the wrong item, please contact me as soon as possible.
Your statutory consumer rights apply to goods supplied by me. Goods must meet the legal requirements applicable to them, including being as described, of satisfactory quality and fit for purpose where required by law.
I will deal with faulty, damaged, incorrectly supplied or otherwise non-conforming goods in accordance with your legal rights.
This section does not replace or restrict any rights you have under applicable consumer law.
11. Original artwork
Each original artwork is individually created by hand.
Natural characteristics such as variations in paint application, brush or pen marks, paper texture, colour variation and other evidence of the handmade process are part of the character of an original artwork.
The photographs and descriptions on the website are intended to provide an accurate representation of each artwork, but minor differences in colour or appearance may occur between the physical artwork and its representation on a screen.
Unless expressly stated otherwise, original artwork is supplied unframed.
12. Copyright and intellectual property
All artwork created by me, including original paintings, drawings and other artistic works, remains my intellectual property and is protected by copyright.
Copyright in my artwork, photographs, website content, written descriptions, branding, logos and other original material remains with Stephen Darling Art unless I expressly agree otherwise in writing.
Purchasing an original artwork, fine art print or other physical product does not transfer copyright or any right to reproduce the artwork.
Unless I have given written permission, you must not:

reproduce, copy or scan my artwork;

create reproductions of my artwork;

sell or distribute reproductions of my artwork;

use my artwork commercially;

reproduce my artwork on merchandise, products, packaging or promotional materials;

use my artwork as part of another commercial design or artwork;

remove or alter copyright notices or artist identification; or
-
use photographs of my artwork for commercial purposes without permission.
You may display artwork that you have legitimately purchased for your personal enjoyment.
Nothing in these Terms prevents any use that is permitted by law, including applicable copyright exceptions.
13. Website content
The website, including its text, photographs, graphics, artwork images, logos, layout and other original content, is owned by or licensed to Stephen Darling Art unless otherwise stated.
You may access and use the website for lawful personal purposes.
You must not reproduce, redistribute, modify, commercially exploit or systematically copy substantial portions of the website or its content without my prior written permission, except where permitted by law.
14. Reviews and customer content
If you voluntarily submit a review, photograph, testimonial or other content to Stephen Darling Art, you confirm that you have the necessary rights to provide it and that it does not infringe another person's rights or contain unlawful or misleading material.
By submitting content for publication, you give Stephen Darling Art permission to use, reproduce and display that content for the purposes of operating and promoting the business, without transferring ownership of your underlying rights.
I may remove content that is unlawful, misleading, defamatory, offensive or otherwise inappropriate.
15. Website use and prohibited activity
You must use the website lawfully and must not:

attempt to gain unauthorised access to the website or its systems;

introduce viruses, malware or other malicious code;

interfere with the operation or security of the website;

use the website to commit or facilitate unlawful activity;

I may restrict or suspend access where reasonably necessary to protect the website, my business or other users.

The website may contain links to third-party websites or use third-party services, including payment, delivery, analytics and other technology providers.
Third-party services are subject to their own terms and privacy policies. I am not responsible for the content, availability or practices of third-party websites that I do not operate.
17. Errors and changes
I take reasonable care to ensure that information on the website is accurate and up to date. However, occasional typographical errors, technical errors or other inaccuracies may occur.
If an obvious error affects an order, including an incorrect price, I will contact you as soon as reasonably possible and, where appropriate, give you the option to proceed at the corrected price or cancel the order for a refund.
I may update the website, products, prices and these Terms from time to time.
The Terms in force when you place an order will generally apply to that order, unless a change is required by law.
18. Liability
Nothing in these Terms excludes or limits liability where it would be unlawful to do so.
Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any statutory consumer rights that cannot legally be excluded or restricted.
Subject to the above, I am not responsible for losses that are not reasonably foreseeable or that arise from circumstances outside my reasonable control, to the extent permitted by law.
19. Events outside my reasonable control
I will not be responsible for failure or delay in performing an obligation where this is caused by circumstances beyond my reasonable control, including serious disruption to postal services, natural disasters, severe weather, strikes, government action, widespread technical failures or other similar events.
Where such an event materially affects an order, I will take reasonable steps to minimise its effects and keep you informed where reasonably possible.
20. Privacy
Personal information collected through the website is handled in accordance with my Privacy Policy.
Stephen Darling Art uses Shopify to operate the online store and may use other service providers where necessary to process payments, fulfil orders, deliver products, operate the website, communicate with customers and provide other business services.

22. Governing law
These Terms are governed by the law of England and Wales.
If you are a consumer living elsewhere in the United Kingdom or in another country, nothing in these Terms prevents you from relying on mandatory consumer protection laws that apply to you and that cannot lawfully be excluded.
Where permitted by law, the courts of England and Wales will have jurisdiction over disputes arising from these Terms or your purchase from Stephen Darling Art.
23. Changes to these Terms
I may update these Terms of Service from time to time to reflect changes to my business, website, products or legal requirements.
The current version will be published on this page, together with the date on which it was last updated.
